1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the empowerHIM digital learning platform ("the Platform"), operated by empowerHIM Counseling & Solutions ("empowerHIM," "we," "us," or "our"). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. Nature of Services — Coaching & Education

empowerHIM is a coaching and personal development platform. Our programs, modules, worksheets, journal prompts, voice journal features, and community features are designed to support personal growth, self-reflection, and skill-building.

Specifically, you understand and agree that:

• empowerHIM services are educational and coaching in nature, not medical, clinical, or therapeutic treatment.
• Our programs draw on evidence-based frameworks (such as cognitive behavioral principles, the Gottman Method, and attachment theory) for educational purposes only. These frameworks are used to inform coaching content, not to diagnose or treat any condition.
• empowerHIM does not diagnose mental health conditions, prescribe medication, or provide clinical therapy.
• No provider-patient or therapist-client clinical relationship is formed by using this Platform.
• Our facilitators, coaches, and content creators are not acting as licensed healthcare providers in connection with the Platform.

3. Eligibility

You must be at least 18 years old to create an account and use the Platform. By registering, you confirm that you are 18 or older and have the legal capacity to enter into these Terms.

4. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information when registering and to keep your information current. You may not share your account with others or allow others to access the Platform through your credentials.

5. User Content and Conduct

You retain ownership of content you submit to the Platform, including journal entries, voice recordings, worksheet responses, and community posts. By submitting content, you grant empowerHIM a license to use, display, and process it as necessary to provide the Platform's features.

You agree not to:

• Post content that is unlawful, harassing, hateful, threatening, or sexually explicit in the community feed or comments
• Impersonate another person or misrepresent your identity
• Use the Platform to harm yourself or others, or to promote self-harm
• Attempt to access another user's data or disrupt the Platform's operation
• Share another person's personal information without consent

empowerHIM reserves the right to remove content and suspend accounts that violate these standards.

6. Payments, Subscriptions, and Refunds

Some programs and features require payment. Payments are processed by Stripe. By purchasing a program or subscription, you authorize Stripe to charge the displayed price.

One-time program purchases: Grant access to a single program. Refunds, if applicable, are at empowerHIM's discretion — contact us through the Contact page.

All-Access membership: Recurring monthly or annual subscription that grants access to all programs. You can cancel at any time from your account or by contacting us. Cancellation stops future charges but does not refund the current billing period. Access continues until the end of your paid period.

7. Intellectual Property

All Platform content — including program curricula, module text, videos, worksheets, illustrations, and the empowerHIM brand — is owned by empowerHIM and protected by intellectual property laws. You may not copy, redistribute, or republish Platform content without permission. Your personal journal entries and worksheet responses remain yours.

8. Disclaimers

The Platform is provided "as is" and "as available," without warranties of any kind. We do not guarantee that the Platform will be uninterrupted, error-free, or that it will achieve any specific result. Coaching and educational content is general in nature and may not be suitable for every individual. You are solely responsible for your decisions and actions based on the Platform's content.

empowerHIM does not provide medical advice. Nothing on the Platform constitutes medical, psychological, or legal advice. Always consult a qualified professional for matters related to your health or well-being.

9. Limitation of Liability

To the fullest extent permitted by law, empowerHIM and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Platform. Our total liability for any claim arising from these Terms or the Platform shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Platform shall first be addressed through good-faith negotiation. If unresolved, the dispute shall be resolved through binding arbitration administered in North Carolina, and judgment on the award may be entered in any court of competent jurisdiction.

11. Account Deletion

You may request deletion of your account and personal data at any time by contacting us through the Contact page. We will process your request within a reasonable period, subject to legal record-keeping obligations (such as payment records).

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date. Continued use after changes take effect constitutes acceptance of the updated Terms. If changes are material, we will provide notice through the Platform or by email.
